Below is a sample of our contract/health guarantee for our puppies.

Health Guarantee:

  1. We assure the puppy’s freedom from life-threatening genetic health conditions for the first 26 months. Exclusions include common puppy/dog issues. To maintain this guarantee, the buyer must:

   – Have the puppy examined by a licensed veterinarian within 72 hours of pickup.

   – Prevent obesity, injury, abuse, spay or neuter before 24 months, and breeding within the first 24 months.

   – Keep the puppy updated on vaccinations, worming.

  1. If a disabling genetic health condition arises before 26 months, a refund is contingent upon returning the puppy and signing registration papers back over to Upper Cumberland Labradors. The seller has the right to conduct a veterinary examination by a vet of seller’s choosing at the buyer’s expense within 5 days of notification of illness
  2. Additional Responsibilities:

   – Buyer agrees to provide proper care, nutrition, medical attention, exercise, rest, and a dry sleeping area.

   – If unable to care for the puppy, the buyer must contact the seller for first rights to take back ownership; the return may involve a partial payment based on the dog’s age and condition up to the purchase price excluding the $500 deposit.

  1. Ownership Transfer and Penalties:

   – Puppy cannot be transferred without the seller’s permission.

   – Unauthorized transfer or surrender results in possession retake, nullification of health guarantees, and a $5,000 fine, plus court costs.

  1. Medical Costs:

   – The puppy receives initial worming and shots; all medical costs post-pickup are the buyer’s responsibility.

  1. Registration and Breeding:

   – Limited Registration unless otherwise agreed. Full registrations granted only to approved breeders.

   – Breeder recommends spaying/neutering no sooner than 24 months at the buyer’s expense.

   – Breeding without full registration or before health testing incurs a $5,000 fine, and the seller retakes possession of the dog and offspring.

  1. Payment and Pickup:

   – Limited Registration fee: $3,000.00-$4,000 depending on the litter.

   – An initial deposit of $100 is required to be placed on the waitlist. An additional $400 is required to be placed once puppies are born to equal the total $500 deposit required to reserve a puppy.

   – $500 deposit required to reserve a puppy. Deposits are refundable up until 7 weeks for any reason and on a case by case basis thereafter minus the $100 initial deposit. Refunds after 7 weeks are solely up to the discretion of the seller.

   – Full registration may be requested contingent on genetic health testing and OFA clearances. Seller has the right to refuse full registration.

   – Final payment in cash at pickup; checks not accepted.

   – Seller may sell the puppy to someone else if the buyer is a no-show.

  1. Training and Guarantees:

   – Seller recommends formal training but offers no guarantees on disposition, temperament, or obedience. It is recommended to purchase and follow the Baxter and Bella training program.

  1. Nutritional Guidance:

   – Research indicates that diet plays a crucial role in preventing disorders and diseases such as hip dysplasia, allergies, arthritis, cataracts, skin issues, cancer, coat problems, stroke, heart disease, etc. To ensure the long-term health of your dog, we recommend feeding a high-quality food throughout its lifetime.

  1. Deposit and Refund Policy:

   – Deposits are non-refundable after 7 weeks of age, subject to the seller’s discretion.

   – Deposits accepted via Venmo, check payable to Trisha or Cory Cross, and cash.

  1. Acknowledgment:

   – By signing, the buyer agrees to the terms, committing to the well-being of the puppy for its life.

  1. Additional Initialed Provisions: (Continued)

– Buyer acknowledges and agrees that the Seller shall provide all registration paperwork if readily available. In the event the paperwork is not immediately accessible, the Seller commits to mailing the registration paperwork to the Buyer’s address promptly upon receipt. Initials: ____

– Within 72 hours (3 business days) of receiving the Dog, the Buyer is required to have a licensed veterinarian conduct a thorough examination. Any identified health concerns must be documented in writing and promptly submitted to the Seller. Failure to adhere to this requirement within the specified timeframe will result in the Buyer having no recourse for replacement, forfeiting all monies paid towards the purchase of the Dog. In the event of a life-threatening condition, as supported by written documentation, the Buyer may return the Dog to the Seller for replacement. The nature of the replacement is solely at the Seller’s discretion, potentially involving a litter mate or a Dog from a future litter. Initials: ____

– The Buyer commits to providing a healthy home environment for the Dog, encompassing but not limited to: i. Adequate, secured space. ii. Sufficient exercise. iii. Proper training and discipline. iv. Continuous socialization. v. Proper nourishment and healthcare. vi. Compliance with licensing requirements dictated by the zoning regulations of the place of residence. Initials: ____

– If the Dog develops a health issue unrelated to heart, hip dysplasia, elbow dysplasia, or eye defects after the sale date, the Buyer will not hold the Seller responsible. Initials: ____

– Puppies are not fully protected from parasites, including but not limited to all worm species, fleas, heartworms, parvovirus, and any other illnesses. Initials: ____

– If, at any time, the Buyer cannot retain possession of the Dog, the Seller is to be notified, granting the Seller the first option to resume full ownership within ten (10) days. Refunds, if applicable, will be at the discretion of the Breeder/Seller. The Dog must be returned with all kennel club registration papers and medical records. The Buyer acknowledges that the Dog is not to be sold or rehomed without prior permission from the Seller. Disregarding this term may result in the Seller confiscating the Dog from the unapproved home, with the Buyer responsible for a $5,000 fee plus court costs. Initials: ____

– The Buyer agrees not to breed the Dog without full registration, before completing proper genetic health testing, or until the Dog reaches at least 24 months of age, demonstrating proper maturity. Disregarding this term may result in the Seller confiscating the Dog from the unapproved home, with the Buyer responsible for a $5,000 fee plus court costs. Initials: ____

– If the quality of life of the Dog is in jeopardy, the Buyer breaches the agreed terms of the contract, or the Dog is being used in illegal activities, the Breeder/Seller reserves the right to confiscate the Dog at any time. Initials: ____

– The Breeder/Seller reserves the right to approve or prohibit any transfer of the Dog to a third party. Under no circumstances will the Dog be sold, leased, traded, or given away to any pet shop, research laboratory, animal shelter, or similar facility. Disregarding this term may result in the Seller confiscating the Dog from the unapproved home, with the Buyer responsible for a $5,000 fee plus court costs. Initials: ____

– Should the Buyer be unable or unwilling to fulfill any of the above provisions, or if the Dog is seized by any local authority for reasons such as running at large, not meeting county or city guidelines, neglected, abused, or abandoned, the Seller retains the right to reclaim this Dog without compensation. – Buyer agrees to pay/reimburse Seller any expenses accrued, including but not limited to court costs, attorney fees, impoundment fees, and transport fees while enforcing the terms and provisions of this contract. Initials: ____

– Seller affirms that puppies are unaffected by CNM, EIC, PRA. Buyer acknowledges this is not a comprehensive health guarantee, and other health issues may arise over the dog’s life. No additional health guarantee is expressed or implied. Initials___

– Buyer acknowledges there is no guarantee on undescended testicles, umbilical hernias, proper bite, size, temperament, trainability, color, weight, size, or shedding factor. Initials____

– Buyer understands the seller has taken precautions against conditions such as coccidiosis, giardia, parasites, mites, UTI’s, ear infections, diarrhea, or bacterial infections. These conditions are treatable and not grounds for return or exchange. The breeder is not responsible for covering vet bills or expenses. Initials___

– Buyer agrees to maintain preventative healthcare, especially regarding hip dysplasia. Hip dysplasia has five major causes: genetics, early spay/neutering, poor diet, over-feeding, and excessive exercise at a young age. Buyer understands the risks associated with prolonged exercise on hard surfaces during the first 18 months of the puppy’s life. Buyer acknowledges hips are not guaranteed due to various external factors. Initials___

– Buyer gives permission to the Seller to use any and all pictures of the purchased dog from any social media page, texts, or e-mail messages for advertisement purposes. Initials: ___
